Condominium - Five Key Issues You Must Know to Insure the Association and the Unit Owner
Description

Placing insurance on a condominium requires that the insurance agent has a clear understanding of what must be insured on the Association Policy and the Unit Owners Policy. This course will focus on five complex issues relating to providing coverage correctly for both the unit owner and the association. It is critical that the insurance agent/broker that writes condominium insurance recognizes the risk exposures; risk solutions and has the ability to interpret the coverages required in the CC & R’s. The course will incorporate case studies as frames of reference to answer the question: “covered—not covered” based on the facts of the cases.  By taking this course the participant will have a better understanding on identifying risk and providing the appropriate policies and endorsements.  The topics that will be covered include:
1.            Understanding the difference between a Cooperative, Townhouse and Condominium;
2.            Reviewing the CC & R of the Association;
3.            Determining what coverages must be provided on the Association Policy for both property owned in association and the units as defined in the CC & Rs;
4.            Review of some key coverages the association must carry specifically D & O insurance and
5.            Review of the unit owner’s policy.

Condominium Case Study - Avoiding the E & O by Doing it Right
Description

Too often we learn from our mistakes or get “lucky” and do it right the first time.  This course will discuss two separate claims on a condominium association both due to windstorm.  In the first case the agent did not provide sufficient coverage which led to court’s finding on the insurance agent’s “special duty to advise”.  In the second case, the agent insisted that the correct coverage be placed and the result was coverage in full.    The important lessons from these claims will highlight how important it is to have an open/educated dialogue with the board of directories and committees AND to have the right support documents when placing coverage.

While both the General Contractor and the Subcontractor both need similar insurance coverage, there are distinctive differences in how these coverages respond to risk.  This course will review several areas:  Builder’s Risk v. Installation Floater; General Liability exclusions; Third Party Action Over claims; OCIP / CCIP coverage.
By the end of this course, the student will have clarity on issues to discuss with the construction client, whether that client is a General Contractor or a Subcontractor.

Description

The objective of this class is to get back to basics and understand how to read insurance policies. All insurance policies have the same components in terms of Declarations Pages; Conditions; Definitions; and Coverages. It is essential that insurance professionals learn to identify where coverage is provided or NOT provided; how to read the policy and understand the importance of words, phrases; punctuation, edition dates, and positioning of coverage. Without these skills, providing insurance becomes transitional, only leading to errors and a lack of professionalism. This course will cover the following:
1. Policy Setup: Declarations, Insuring Agreement, Coverages, Exclusions, Definitions (DICED)
2. How to read a policy and understand what coverage is granted or not granted based on insurance “reading skills”.

3. Understanding changes that have occurred over time within the coverage forms and what a difference addition and removal of words and phrases make to the claim payment or claim denial.

This course will focus on how to avoid errors and omissions from three different perspectives:

  1. Digital/Electronic E & O
  2. Fraud and Errors and Omissions
  3. Review of an agent’s E & O Policy…what’s covered and what’s NOT
The digital/electronic E & O section will highlight the growing vulnerability for an insurance broker/agent and insurance company stemming from the internet and tech exposures. The course will discuss errors and omissions stemming from such issues as the Agency Management System, use of the internet, an agent’s web site, and use of an intranet, e-mail and social networking. Fraud and E & O is a growing concern and must be identified and dealt with immediately in compliance with the law and agency procedures. An agent purchases E & O coverage as a last resort. The class will address what is covered, what is not covered, deductibles and self-insurance.
