Insurance Issues Relating to the Independent Contractor vs. Employee and the PEO Solution
Description

This course will focus on how to identify the makeup of an insured’s workforce to determine how they must provide insurance through their business and understanding transfers of insurance responsibility. The person performing the services may be an independent contractor; an employee (common-law employee); a statutory employee or a statutory non-employee. Every state has regulations that relate to leasing employees, both for the Professional Employer Organization (PEO) and for the business that is utilizing them. This course will cover the following topics:

  1. Determining whether the individuals providing services are employees or independent Contractors
  2. Common Law Rules that provide evidence of the degree of control and independence that fall into three categories
  3. Providing insurance for the employee/independent contractor
  4. Discussion of the PEO as relates transfer of insurance obligations in several areas including: Workers Compensation, EPLI and Crime
